LATEST UPDATE ON EPCS

RE :- Further explanation on EPCs

It appears that my earlier note added to the confusion as I did not make it clear that the change of life for an EPC from one to three years related only to domestic properties offered for sale only.

For Residential properties being let and for non-domestic properties the EPC lasts up to 10 years.

I am also setting out a clearer description for each type of property.

Domestic Property to be let. From 1st October An EPC must be available to prospective tenants. However you only need to get one when you are looking to create a new tenancy. Properties currently let do not need one nor will they if an existing tenant signs a new lease or the tenancy goes periodic. The EPC lasts up to 10 years.

Commercial Property - other than for a small number of exceptions, All newly marketed Commercial property that are offered for sale or to let from 1st October will need an EPC. And the guidelines say that this needs to be available to potential purchasers or tenants either when written material is given out or when a viewing is done. The EPC lasts up to 10 years
Commercial Property that is already on the market before the 1st October and is then continually marketed do not need an EPC before the 1st January 09. However if it is sold or let in the meantime there is an obligation to provide and pass on an EPC.

Domestic Properties For Sale. – After much confusion the Minister has confirmed that all residential properties for sale, marketed after the 1st October, will need an EPC. This does not mean that pre-HIP properties now need a HIP, only an EPC. In addition the pre-HIP properties can continue to be marketed from 1st October whilst you sort out the EPC and, unlike properties with a HIP, there is no requirement to display the EPC graph on particulars although CLG would like you to. The EPC has to be made available “as soon as possible”. The EPC lasts up to 3 years.

Stamp duty abolished on some homes

HOMES worth £175,000 or less are to be exempted from stamp duty for 12 months as part of a package to revive the housing market, the Chancellor announced today.

The change, which comes into effect tomorrow, raises the threshold on which 1% stamp duty is paid from its current level of £125,000.

The move will save eligible home-buyers up to £1,750 when they purchase a property, and relates only to buildings entirely for residential use.

In a statement, the Treasury said: "The Chancellor of the Exchequer has today announced that stamp duty land tax will not apply to purchases of residential property of £175,000 or less.

"This will provide an exemption from stamp duty land tax for land transactions consisting entirely of residential property where the chargeable consideration is not more than £175,000.

"This relief will apply to transactions with an effective date on or after 3rd September and before 3rd September 2009."

The UK's biggest mortgage lender today welcomed the Government's announcement that it was abolishing stamp duty on properties worth up to £175,000.

The move means anyone buying an averaged priced house is likely to avoid having to pay the tax, relieving some of the pressure on hard-pressed first-time buyers.

A Halifax spokeswoman said: "We welcome the Government's stamp duty initiative. This is a sensible measure and it will help the housing market."
